The Dangers of Conservative ‘Antitrust Revival’

Since it first appeared in 1978, this seminal work by one of the foremost American legal minds of our age has dramatically changed the way the courts view government’s role in private affairs. Now reissued with a new introduction and foreword, this classic shows how antitrust suits adversely affect the consumer by encouraging a costly form of protection for inefficient and uncompetitive small businesses. Robert Bork’s view of antitrust law has had a profound impact on how the law has been both interpreted and applied. Lucid, highly readable, and full of rich social and political implications, The Antitrust Paradox illustrates how the purpose and integrity of law can be subverted by those who do not understand the reality law addresses or who seek to make it serve unintended political and social ends. It’s republication by his son comes at a critical moment when politicians on both the left and right want to weaponize antitrust law. Their proposals will destroy capitalism and innovation. 

Robert H. Bork, Jr., heads the Bork Group, a 18-year-old virtual crisis, litigation, and public affairs agency, which draws from the best, most-experienced, independent communications talent. Mr. Bork has designed strategies for clients in many high-profile cases and policy battles. His experience includes directing the public affairs strategy in critical issues for Eli Lilly, Google, AT&T, and the U.S. Chamber of Commerce’s Institute for Legal Reform, to name just a few. He began his career as a journalist as a police reporter before moving to business and economics. As a journalist, he covered international economics at U.S. News and World Report, was managing editor of the quarterly journal Regulation, and worked as a reporter at Forbes, The Detroit Free Press, The Fort Worth Star-Telegram and The Miami Herald. Mr. Bork made the switch to advocacy in 1987 working at the Heritage Foundation, on Capitol Hill as an aide to U.S. Sen. Gordon Humphrey (R-NH), and as special assistant for U.S. Trade Representative Carla Hills. Throughout his career, Mr. Bork has specialized in the development and implementation of communication strategies in crises, litigation, and legal policy. In his many years of experience managing the public environment surrounding high-profile matters, he has worked directly with CEOs, general counsel, and communications executives of major U.S. and international corporations. Mr. Bork’s range of experience includes antitrust, product liability, intellectual property, securities fraud, economic espionage, white-collar crime, mergers and acquisitions, First Amendment and employment discrimination. His work has been on behalf of clients ranging from the automobile industry to pharmaceuticals, computers, software, chemicals, railroads, franchising, telecommunications, insurance, health-care, and former manufacturers of lead pigment. In every matter he has worked directly with the client’s legal counsel. Mr. Bork graduated from Carleton College with a degree in American history. He was a Herbert J. Davenport Fellow in Business and Economic Journalism at the University of Missouri School of Journalism.

Americans are understandably squeamish about official racial and ethnic classifications. Nevertheless, they are ubiquitous in American life. Applying for a job, mortgage, university admission, citizenship, government contracts, and much more involves checking a box stating whether one is Black, White, Asian, Hispanic, or Native American.

While reviewing the surprising history of American racial classifications, Classified raises questions about the classifications’ coherence, logic, and fairness; for example:

• Should Pakistani, Chinese, and Filipino Americans be in the same category despite their obvious differences in culture, appearance, religion, and more?

• Why does the government not allow Americans to classify themselves as bi- or multi-racial?

• How did the government decide that a dark-complexioned, burka-wearing Muslim Yemini should be classified as generically white, but a blond-haired, blue-eyed immigrant from Spain should be classified as Hispanic and treated as a member of a minority group?

• Why does the government require biomedical researchers to classify study participants by the official racial categories, when the classifications have no scientific basis?

In an increasingly diverse society with high rates of intergroup marriage, the American system of racial classification is getting even more arbitrary and absurd. With rising ethno-nationalism threatening democracy around the world, it’s also dangerous. Classified argues that the time has come to consider abolishing official racial classification and replace it with the separation of race and state.

David E. Bernstein holds a University Professorship chair at the Antonin Scalia Law School, George Mason University, where he has been teaching since 1995. He has also been a visiting professor at the University of Michigan, Georgetown University, William & Mary, Brooklyn Law School, and the University of Turin.

Known as a fearless contrarian, Professor Bernstein often challenges the conventional wisdom with prodigious research and sharp, original analysis. His book Rehabilitating Lochner was praised across the political spectrum as “intellectual history in its highest form,” a “fresh perspective and a cogent analysis,” “delightful and informative,” “sharp and iconoclastic,” “well-written and destined to be influential,” and “a terrific work of historical revisionism.” Professor Bernstein blogs at the Volokh Conspiracy (the leading law professor blog) and at Instapundit.com. Professor Bernstein is a graduate of the Yale Law School, where he was senior editor of the Yale Law Journal and a John M. Olin Fellow in Law, Economics, and Public Policy.

Professor Bernstein is married and has three children of mixed Eastern European, Middle Eastern, and Spanish-Jewish origin. He prefers not to classify them.

Dr. Ivan Eland is Senior Fellow at the Independent Institute and Director of the Institute’s Center on Peace & Liberty. He is author of War and the Rogue Presidency: Restoring the Republic after Congressional Failure.

The Office of the President of the U.S. isn’t what it used to be—it has morphed into an overgrown beast. So says presidential scholar Ivan Eland in his landmark new book War and the Rogue Presidency: Restoring the Republic after Congressional Failure.

The presidency no longer simply enforces the laws passed by Congress but literally dominates American political life. Its vast bureaucracy is flush with cash and wields powers never authorized by the Framers. But who do we have to thank for this distortion of the Constitution? Congress.

The presidency, says Eland, isn’t inherently imperial. It’s contingently imperial. Particularly when wars loom and Congress refuses to forestall our engagement in them—with inevitable consequences. Armed conflict bloats armies and emboldens the commanders-in-chief who wield them. Presidents, for instance, now unilaterally start wars and kill Americans (and others) overseas without due process.

But wars also lead to massive domestic government interference. Income tax, estate tax, gas taxes, the IRS, public housing, rent control, inflationary money printing, financial bailouts—all have their origins in wartime

The solution is clear. Congress, says Eland, simply must refuse to fund the undeclared wars presidents seem bent on waging. Yet to do that Congress must first implement reforms detailed in this book: weaken the committee structure; eliminate the seniority system, outlaw covert destabilization of foreign governments, and back federal courts seeking to limit the national security state—and many more.

In sum, liberals, conservatives, independents—anybody concerned for personal liberties and good governance—should read this pathbreaking book and grapple with its implications. For they are wide-ranging and entail staggering consequences for a free people.
